Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your use of the Commons mobile apps and website (the "Service"), operated by Commons ("we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Commons lets groups organize into shared spaces with chat, polls, documents, and other content. Spaces are invite-only: what you post in a space is visible to that space's members.

3. Eligibility and your account

• You must be at least 13 years old to use the Service.
• You sign in with your mobile phone number and a one-time code sent by SMS. You are responsible for maintaining control of your phone number and for activity that occurs under your account.
• You agree to provide accurate information and to keep it up to date.

4. Your content

You own the content you post to Commons. So that we can operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your content solely as needed to provide the Service — for example, delivering your messages to the members of your spaces and syncing content across devices. This license ends when you delete your content or your account, except where content has been shared with others who have not deleted it, or where we are required to retain it by law.

5. Acceptable use

You agree not to use the Service to:

• Break the law, or infringe the rights of others, including intellectual property and privacy rights.
• Harass, threaten, or abuse others, or post content that is unlawful, exploitative, or harmful to minors.
• Send spam, or attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the Service, including probing, scraping, or reverse engineering except as permitted by law.

6. Spaces, roles, and members

Space owners and admins can manage their space, including inviting and removing members and moderating content within the space. When you join a space, the content you post there is visible to its members even if you later leave the space, unless you delete it.

7. Text messaging

The Service uses SMS to deliver one-time sign-in codes. By providing your phone number you consent to receive these messages; message and data rates may apply. We do not send marketing text messages.

8. Termination

You may stop using the Service, or request account deletion, at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if operating the Service becomes impractical, with notice where reasonably possible.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim and one hundred US dollars.

11. Changes to the Service or these Terms

We may modify the Service or these Terms as Commons evolves. When we make material changes to these Terms, we will update the effective date above and notify you in the app or by other reasonable means. Continuing to use the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the United States and the state in which the operator of Commons resides, without regard to conflict-of-law principles.
